Trump Takes Away the Right of Peaceful Assembly – First Amendment Violation

First Amendment: “Congress shall make no law … abridging … the right of the people peaceably to assemble, and to petition the government for a redress of grievances."      On June 1, 2020, peaceful demonstrators were protesting the taking of George Floyd’s life by placing a police knee on his neck until he could not breathe. There had been a number of killings by police, which resulted in a great many peaceful demonstrations around the country. It is certainly the responsibility of the president to tell the difference between looters and peaceful demonstrators. The First Amendment demands there be a distinction. Lafayette Square, near the White House has been a traditional site for peaceful demonstrations to protest various matters and petition the government for redress of grievances. At 6:32pm, in the evening of June 1, 2020 several hundred officers in riot gear advanced on the demonstrators. At 6:35pm, one officer threw a chemical grenade at the d...

President Trump Ruminates Running Third Term – 22nd Amendment Violation

On Saturday, President Trump said he was going to win Nevada and then he was going to negotiate to run again in 2024. He said he was entitled to another four years based on  “ the way we were treated.” That is an unconstitutional remark. It wasn’t accidental because he made a similar comment in Wisconsin in August. He said he would go for another four because “they spied on my campaign.” Amendment 22 to the US Constitution, ratified on February 27, 1951, provides in part, “No person shall be elected to the office of the president more than twice.” A very brief history of that amendment includes George Washington’s starting a tradition that no president should serve more than two terms. The process of adopting the 22 nd amendment started in congress on March 21, 1947. The amendment was adopted on February 27, 1951, almost four years later. The process is cumbersome and can involve the congress and the states. In the case of the 22 nd amendment that was adopted by 36 of the 48...

Who Will Defend the Courts From Attacks on the Judiciary?

The constant repetition of attacks on our court system, our judges, and jurors, which included racial slurs, and erroneous factual and legal arguments aimed at bullying the judicial system, is a violation of the separation of powers which is at the beginning of the U.S. Constitution. Donald Trump has taken an oath to defend the constitution but instead he is attacking a separate branch of the government. The question I raise in my article published by the Daily Journal, who will defend the courts against this bully? Without exaggeration, Donald trumps constant unconstitutional assertions and conduct will be described on this blog as long as it is relevant to counteract Trump and Trumpism. For example, he has recently suggested that he would have a third term which is a violation of the constitution.  JJB Copyright 2020 James J. Brosnahan

What Is This Website For?

As a long time trial lawyer, I've noticed a lack of accountability for Donald Trump's continuous violations of the United States Constitution. I have begun to describe those violations for lay people and lawyers. This is not a political blog it will be an effort to keep track of all of President Trump’s constitutional violations.   JJB
